1. Introductory Provisions
These terms summarize the relationship between the seller (us) and the buyer (you). They differ if you purchase as a business. By purchasing from us, you agree to them.
1.1 These Terms and Conditions of Equinox Europe, s.r.o., with its registered office at Karásek 2121/11, Brno, Company ID 29224276, registered in the Commercial Register maintained in Brno, Section C, File 66872, regulate in accordance with Section 1751(1) of Act No. 89/2012 Coll., the Civil Code, the mutual rights and obligations of the contracting parties arising in connection with a purchase agreement concluded via the online store at www.equator-cycling.com.
1.2 These Terms and Conditions do not apply in cases where the person purchasing goods acts within the scope of their business activity or is a legal entity.
1.3 Deviating provisions may be agreed upon in the purchase agreement. Such provisions take precedence over these Terms and Conditions.
1.4 The Terms and Conditions form an integral part of the purchase agreement.
1.5 The seller may amend or supplement the wording of these Terms and Conditions.
2. User Account
You agree to provide truthful and up-to-date information so that we can conduct business together.
2.1 Based on registration, the buyer may access their user account and place orders for goods.
2.2 The buyer is obliged to provide correct and truthful information and update it when changes occur.
2.3 The buyer is obliged to protect access credentials to their account.
2.4 The buyer is not authorized to allow third parties to use their account.
2.5 The seller may cancel the account especially in the event of long-term inactivity or breach of these terms.
2.6 The user account may not be available continuously due to system maintenance.
3. Conclusion of the Purchase Agreement
Prices on the website include VAT and remain valid until changed.
3.1 All presentation of goods in the web interface of the store is of an informative nature.
3.2 The web interface contains information about goods including prices.
3.3 The order form contains in particular information about the ordered goods, the method of payment of the purchase price, delivery method and costs associated with delivery.
3.4 Before submitting the order, the buyer may check and correct the entered data.
3.5 The seller may request additional confirmation of the order.
3.6 The contractual relationship arises upon confirmation of the order by email.
4. Price of Goods and Payment Terms
The price of goods shall be paid by bank transfer or payment card.
4.1 Together with the purchase price, the buyer shall pay the costs associated with delivery of the goods.
4.2 The seller may require a deposit.
4.3 In the case of cashless payment, the price is payable within 3 working days.
4.4 The buyer’s obligation is fulfilled once the amount is credited to the seller’s account.
4.5 Discounts on the price of goods cannot be combined.
4.6 The tax document will be sent by email.
5. Withdrawal from the Purchase Agreement
The buyer may withdraw from the contract within 14 days of receiving the goods in accordance with the Civil Code.
The goods must be returned unused and the buyer bears the cost of returning them.
6. Transport and Delivery of Goods
The buyer is obliged to check the shipment upon receipt and report any damage to the carrier.
7. Warranty Conditions
The buyer will receive by email a link to a section containing detailed warranty conditions.
8. Rights from Defective Performance
The seller is responsible for ensuring that the goods are free of defects upon receipt.
The buyer may submit a complaint within 24 months of receiving the goods.
9. Other Rights and Obligations of the Contracting Parties
9.1 The buyer acquires ownership upon payment of the full purchase price.
9.2 Complaints may be sent to info@equator-cycling.com.
9.3 The Czech Trade Inspection Authority is competent for out-of-court dispute resolution.
10. Personal Data Protection
Personal data are processed to the extent necessary for the performance of the contract and legal obligations.
11. Sending Commercial Communications and Cookies
The buyer agrees to receive commercial communications and to the use of cookies.
12. Delivery
The buyer may be contacted at their electronic address.
13. Final Provisions
Legal relations are governed by the laws of the Czech Republic.
